Who we are
This website is operated by GH Migration and Education Services (ABN 78 844 882 151). Our registered migration agent is Pawandeep Monga (MARN 2619576). In this policy, “we”, “us” and “our” refer to GH Migration and Education Services.
We handle personal information in line with the Privacy Act 1988 (Cth) and the Australian Privacy Principles. We advise clients in Australia and other countries. If you live outside Australia, the data protection laws in your country may also apply and give you additional rights. We will respect those rights where they apply to us.
What we collect
When you send an enquiry through our website, we collect:
- your name, phone number and email address
- your country of residence and, if you choose to tell us, your country of citizenship
- the service you are interested in
- the message you write to us
When you contact us by phone, WhatsApp or email, we collect the information you choose to share.
If you become a client, we collect the information and documents needed to give you migration advice and prepare your application. This may include sensitive information such as health details, criminal history, or details of your relationships and family. We collect sensitive information only with your consent or where it is required for your application.
We may also receive information about you from other people involved in your matter, such as a sponsor, employer, partner, family member, education provider or skills assessment authority. If you give us information about another person (for example, a partner or child included in your application), please make sure they know you are sharing it with us.
You can make a general enquiry without giving your name, but we will need to identify you before we can give you migration advice.
How we use it
We use your information to respond to your enquiry, provide our services, prepare and lodge applications on your behalf, meet our legal and professional obligations, and keep records as required by the Code of Conduct for registered migration agents.
We do not sell your personal information, and we do not use it for direct marketing without your consent.
Website tools and service providers
Our website is hosted by Cloudflare. Our enquiry form is protected by Cloudflare Turnstile, which checks that submissions come from a person rather than an automated program. To do this, it processes technical information about your device and browser. We do not use analytics or advertising cookies on this website.
Enquiries are sent to us by email through a service provider and are kept in our email system. They are not stored in a separate website database. These providers may process data outside Australia, including in the United States.
Disclosure
With your consent, or where the law requires or allows it, we may disclose your information to:
- the Department of Home Affairs and the Administrative Review Tribunal
- education providers and skills assessment authorities
- sponsors, employers and other parties involved in your application
- service providers who help us run our business, such as email, cloud storage, translation and accounting providers
- our professional indemnity insurer and legal advisers
- the Office of the Migration Agents Registration Authority (OMARA), where required
Clients outside Australia
If you live outside Australia, we exchange messages and documents with you across borders, for example by WhatsApp, video call and email. These services may store data in other countries. Before we disclose your information to anyone overseas, we take reasonable steps to make sure it is handled in line with the Australian Privacy Principles, unless you agree otherwise after we explain the risks, or the law allows it.
Your rights
You can ask to access or correct the personal information we hold about you. We may need to confirm your identity first. We will respond within 30 days and will not charge you for making a request. Depending on where you live, you may also have the right to ask us to delete your information where we are not required to keep it, or to withdraw your consent. Contact us at [email protected].
Security and retention
We take reasonable steps to protect your information from misuse, interference, loss and unauthorised access, modification or disclosure. If a data breach is likely to cause you serious harm, we will notify you and the Office of the Australian Information Commissioner as required by law.
We keep client records for seven years as required by our professional obligations, then securely destroy them. If you make an enquiry but do not become a client, we keep your enquiry for up to 12 months and then delete it.
Complaints
If you have a privacy concern, contact us first at [email protected] and we will respond within 30 days. If you are not satisfied, you can contact the Office of the Australian Information Commissioner (oaic.gov.au). If you live outside Australia, you may also be able to contact the data protection authority in your country.
Complaints about the conduct of a registered migration agent can be made to OMARA.
